Can my Medigap insurer terminate my policy?
Answered by 49 licensed agents
With explanation medigaps are guaranteed renewable which means as long as you pay your premiums and and was honest on your application you cannot be canceled.
So unless the insurer goes belly up your medigap cannot be cancelled.

Medigap plans cannot cancel your plan or raise your rates based on your individual claims.

If you have a carrier that enters you into a group plan, then not only are you subject to the group rates being increased regularly, annually, or at the carrier’s discretion, but also if it is deemed there are too many claims into that particular group, they could drop the plan.
Look for a Supplemental carrier that offers a Guaranteed Renewable Premium with an Individual policy.

Here would be the circumstances that an insurer can cancel a Medigap policy.
*Non-payment of premium: Failing to pay your premiums is the most common reason for cancellation.
*Material misrepresentation or fraud: If you are found to have provided false information on your application, especially related to your health, the insurer can cancel the policy.
*Insolvency or bankruptcy: If the insurance company goes out of business, it can lead to the termination of your policy. In this case, you may have a guaranteed issue right to enroll in another Medigap policy without medical underwriting.

There are only a few situations where a Medigap company is allowed to end your policy:
• You stop paying your premiums.
If the payment goes past the grace period (usually about a month), they can cancel it.
• You gave false information when you applied.
If the insurer can prove you intentionally misrepresented something important on your application, they can terminate the policy.
• The insurance company goes bankrupt or stops selling Medigap plans altogether.
If they pull out of the Medigap market in your state, they can drop all policies—though you get special rights to switch to another plan without medical underwriting.
Outside of these situations, a Medigap insurer cannot drop you because of your age, your health, a new diagnosis, or because your medical care has gotten expensive.

There have been Medigap carrier become insolvent and pull out of the market, however, you are protected in this situation. If this happened to you, you would have guaranteed issue rights to get another plan with no underwriting. The guaranteed issue plan is a Plan G or Plan F depending on when you became eligible for Medicare.

Today's question is, can my Medigap insurer terminate my policy? The only way your Medigap insurer could terminate your policy is for nonpayment or if they go out of business. That's the only way these policies could be canceled if the company is in business and your premiums are paid in full and are up to date. These policies are not cancelable.

Medigap insurers can raise your premium every year as they see fit but still have to keep you insured no matter what your health condition.

1. Non-payment of premium
2. Fraud or material misrepresentation (i.e. lying about health history, smoking, etc..)
3. the carrier goes out of business (i.e. bankruptcy, etc..)
If the third scenario occurs, you have the right to move to another carrier w/out underwriting (i.e. you are guaranteed issuance)

Here's a more detailed breakdown:
Guaranteed Renewability:
Medigap policies are designed to be renewable, meaning the insurer cannot cancel your policy simply because your health has declined.
This protection is in place as long as you continue to pay your premiums.
Reasons for Cancellation:
Non-payment of premiums:
.
If you fail to pay your monthly premiums, the insurer can cancel your policy.
False information on application:
.
Providing inaccurate or misleading information during the application process can also lead to cancellation.
Insurers going out of business:
.
If your insurance company becomes bankrupt or insolvent, your policy may be terminated.
Important Considerations:
Switching to Medicare Advantage:
.
If you decide to switch from Original Medicare to a Medicare Advantage plan, you may lose your guaranteed issue rights for Medigap policies.
State regulations:
.
Some states have additional regulations regarding Medigap policies, so it's wise to check with your state's insurance department for specific rules.

1. You made a "material misrepresentation" on the application for insurance. In other words, "You lied".
2. You stop paying the policy premium.
3. The insurance company goes out of business. Most states have funds allotted to protect consumers should this occur.

Other ways Medigap policies can get cancelled are:
1. The Beneficiary loses Part A or Part B
2. If the Medigap Insurance company leaves the market.
If the insurance company leaves the market your policy will technically cancel but it opens up a guaranteed issue window to pick another Medigap plan offered in your state. (federal guarantee issue right).
I hope this helps
