Can my Medicare Advantage plan drop me, and what happens if it does?

Answered by 9 licensed agents

There are circumstances where a Medicare Advantage plan can you drop you as a member, but it is regulated and can't be due to your health or increased utilization. Typically it is due to non-payment of premium, moving outside of covered service area, you become no longer eligible and enrolled in Part A and Part B as required, or the plan exits the market that you are living in, or the plan no longer meets the requirements to offer the plan through Medicare.

If you are dropped it will trigger a Special Enrollment Period (SEP) and you will be able to enroll in a new plan without waiting for Annual Enrollment Period (AEP) or Open Enrollment Period (OEP).

If your Medicare Advantage ("MA") Plan has a premium, and you fail to make the premium payment, it can cancell your plan. It that happens you will have to wait until the Annual Enrollment Period to enroll in a new plan and you may receive a penalty from Medicare for not having a plan.

An MA can leave your service area and in that instance you will receive a Special Election Period to enroll in a new MA Plan in your service area as you lost your plan at no fault of your own.

The short answer is yes. The explanation of that short answer is a little more involved. There are a couple of situations in which you could be dropped from a plan.

1) If your plan has a monthly premium and you do not pay it, they can terminate your coverage for non-payment.

2) If you are on a Dual plan because you had BOTH Medicare AND Medicaid, but you lost Medicaid, then you have 6 months to get on a non dual plan or your coverage will be dropped.

3) If at the end of the year, your plan is being discontinued but you do not select a new plan, then on Jan 1st, you will not have Advantage plan coverage.

In all of these instances though, you will still have your A & B so you still have coverage through Original Medicare.

Yrs you can be dropped if no premiums are paid, you move away from the coverage area, or the insurance does not provide coverage in that area anymore. If this happens you will be automatically converted to original Medicare but you will lose your part prescription coverage covered by Medicare Advantage plan

In most cases, a Medicare Advantage plan cannot simply drop you because you have health problems or because you are using your benefits. However, there are certain situations where your coverage can end:

* You move outside the plan’s service area.

* You lose eligibility for Medicare Parts A or B.

* You fail to pay any required plan premiums.

* The plan terminates its contract with Medicare.

* The insurance company decides to discontinue the plan. (medicare.gov)

What Happens If Your Plan Ends?

If your Medicare Advantage plan is discontinued or its contract with Medicare is not renewed, you will receive advance notice and typically have a Special Enrollment Period to choose another Medicare Advantage plan or return to Original Medicare. Depending on your circumstances and state, you may also have certain protections when applying for a Medicare Supplement (Medigap) policy. (medicare.gov)

The Bottom Line

A Medicare Advantage plan cannot drop you simply because you become sick, develop a chronic condition, or use expensive healthcare services. If your plan does leave the market or you become ineligible, Medicare provides opportunities to choose new coverage so you’re not left without healthcare benefits.

They can choose to exit the market. You will receive several notices in advance providing a date the plan will discontinue, along with your options to find new coverage.

Yes. A Medicare Advantage plan can disenroll a member in certain situations.

Not paying plan premiums (if applicable) after required notices and grace periods.

Moving outside the plan's service area.

Losing eligibility for Medicare Part A or Part B.

Providing fraudulent information or engaging in certain forms of plan misuse.

The plan's contract with Medicare ends, or the plan leaves your area.

In most cases, your Medicare Advantage plan can't simply drop you because of your health. However, if the plan leaves your area, stops offering coverage, or you move outside the service area, you may need to choose a new plan. The good news is that Medicare gives you a Special Enrollment Period, so you'll have an opportunity to enroll in another Medicare Advantage plan or return to Original Medicare. If this happens, don't panic—just make sure you review your options before the deadline.
